1. DEFINITIONS AND INTERPRETATION

1.1 Definitions

In these Terms of Service, the following definitions apply:

  • "Administrator" means a User designated by an Event Organizer to help manage specific events.
  • "AI-Generated Content" means reports, analytics, and insights created by our AI Services.
  • "AI Services" means our artificial intelligence-powered reporting and analytics features that process Event Data to generate insights and reports.
  • "Attendee" means a User who registers for or participates in Events created on the Platform.
  • "Company", "we", "us", or "our" means FAICON SA.
  • "Content" means all information, data, text, messages, software, images, photographs, graphics, video, sounds, or other materials (regardless of source).
  • "Event" means any in-person, virtual, or hybrid event created and managed through the Platform.
  • "Event Data" means all data related to Events, including User information, session data, engagement metrics, and analytics.
  • "Moderator" means a User who facilitates or moderates Event sessions.
  • "Organizer" means a User who creates and manages Events using the Platform.
  • "Personal Data" has the meaning given under the Swiss Federal Act on Data Protection (FADP) and the EU General Data Protection Regulation (GDPR).
  • "Platform" means the FAICON Event management software platform and all related services.
  • "Services" means all services provided by the Company including Event registration, venue management, virtual/hybrid/in-person Event hosting, and AI-powered reporting features.
  • "Speaker" means a User who presents or speaks at Events.
  • "Terms" means these Terms of Service as may be amended from time to time.
  • "User", "you", or "your" means any individual or entity accessing or using the Platform.
  • "User Content" means Content created, uploaded, or shared by Users.

1.2 Interpretation

References to sections mean a section of these Terms. Headings are for convenience only and do not affect interpretation.

2. ACCEPTANCE OF TERMS

2.1 Agreement to Terms

By accessing, using, or registering for the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Platform.

2.2 Legal Capacity

You represent and warrant that:

  • You have the legal capacity to enter into these Terms.
  • If acting on behalf of an organization, you have the authority to bind that organization to these Terms.
  • You are accessing the Platform from a jurisdiction where such access is legal.

2.3 Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified to Users at least 30 days in advance via email or Platform notification. Changes will be effective upon the specified date. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms. Should you not accept the changes you have the right to terminate your account before the entry into force of the change in accordance with Section 10.2.

3. DESCRIPTION OF SERVICES

3.1 Platform Services

The Company provides a Platform that includes:

  • Event registration and management tools
  • Venue management capabilities
  • Virtual, hybrid, and in-person Event hosting
  • AI-powered reporting and analytics on Event sessions
  • User management for various roles (Organizers, Administrators, Attendees, Speakers, Moderators)
  • Data processing and storage services

3.2 AI Services Disclosure

IMPORTANT NOTICE: Our Platform uses artificial intelligence technology for reporting and analytics.

  • When you use our reporting features, you are interacting with AI systems that analyze Event Data.
  • AI-Generated Content is created through automated processing of Event Data.
  • AI Services may make decisions about data analysis and report generation.
  • Users will be clearly notified when AI is being used to process their data or generate reports.
  • All AI processing complies with applicable transparency and disclosure requirements.

3.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice to Users. Material changes will be communicated at least 30 days in advance.

4. USER ACCOUNTS AND REGISTRATION

4.1 Account Creation

To use certain features of the Platform, you must create an account by providing accurate and complete information including your email address and, where applicable, optional social media profile information (Facebook, LinkedIn).

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account
  • Using strong passwords and enabling available security features
  • The backup and protection of your data and contents of your account

4.3 Account Information

You must ensure that all information provided is accurate, current, and complete. You must promptly update any changes to your information. We may verify the accuracy of information provided.
